The law regarding Home Tuition is complex and the individual circumstances of your child will dictate whether or not your child is entitled to Home Tuition.  Please note Home Education is treated differently in law to Elective Home Education or Education Otherwise than at School EOTAS.

Section 7 of The Education Act 1996 states that there is a duty of parents to secure education of children of compulsory school age

The parent of every child of compulsory school age shall cause him to receive efficient full-time education suitable—

a: to his age, ability and aptitude, and
b: to any special educational needs he may have,

either by regular attendance at school or otherwise.

Home Tuition

Elective Home Education

Parents are often misled by Local Authorities and are told that once their child is of statutory school age they must attend school. This is incorrect as the law states that each child must receive a suitable education regardless of whether this is delivered at school or otherwise.

Elective Home Education

If you wish to electively home educate your child then it is important to seek expert legal advice to discuss the pros and cons of such a decision. A parent who electively home educates their child usually does so at their own expense.

EHCP/Statemented or IDP

EHCP/Statemented/IDP children who are on the role of a special school are treated slightly differently. Before embarking on an elective home education call me to arrange an initial consultation to ensure that you have all the relevant information before you make a final decision.

Education Otherwise Than at School

EOTAS is the most complex area of Special Education Law and if you are considering requesting an EOTAS package (Education Otherwise than at School) from your Local Authority then you urgently need to seek expert legal advice at the earliest opportunity. I have represented a large number of parents seeking such provision and have successfully advocated for a number of clients and secured wins at Tribunal in respect of EOTAS packages.

EOTAS Costs

If the Local Authority agrees that your child requires an 'Education Otherwise than at School' package then it must pay the full costs. The law pertaining to Education Otherwise than at School (EOTAS) is contained in Section 61(1) of the Children and Families Act 2014 (England) and Section 319 of the Education Act 1996 (Wales).

Home Based Programmes

Parents may wish their child to be educated through Home-Based programmes such as Applied Behaviour Analysis (ABA), Son-Rise, Relationship Development Intervention (RDI), Greenspan, Growing Minds, Verbal Behaviour (VB), or a Bespoke Education Otherwise Package etc...

EOTAS Package

A Local Authority can arrange for your child's special educational needs to be met via an EOTAS package if it considers that some or all of your child's special educational needs cannot be met within a school setting.
